Objection: “This Note Is Legal Tender!”

(Crossposted from the Tenth Amendment Center's Constitutional Tender Blog)

In 2009, when Georgia Rep. Bobby Franklin introduced my first version of the Constitutional Tender Act (HB 430) in the Georgia House, we knew it wasn’t just going to be difficult to get passed into law — it was going to be difficult to get any co-sponsors, it was going to bee ord in the Senate…

In short, it was going to be difficult, all around. Why? Because the bill would actually return the State of Georgia to obedience to the U.S. Constitution… and we knew that almost every single legislator there was clueless about what the Constitution actually required, at least when it came to monetary policy.

So, when the bill (which did get one co-sponsor — Rep. Barry Loudermilk, who later won a seat in the State Senate and is now running for U.S. Congress) was assigned to the Banks and Banking Committee, we were happy. Not only was that the right committee, it was a good committee, for a number of reasons… not the least of which was, because the Chairman was a friend of mine for whom I had campaigned when I lived in his district.

I knew he was a staunch limited-government conservative. I knew he took his oath to the Constitution seriously. And I knew he would be willing to at least listen to why this bill was needed. So when I asked him to actually give the bill a chance, he said he’d “do what he could”. And he did — he assigned it to not one, but two subcommittees, and we set to work with a coalition of grassroots activists across the State to pressure at least one of those Chairmen to hold a hearing.

Honestly, we didn’t hold out much hope for that happening. It was late in the session, which made it more unlikely we’d see any action at all. So, when we suddenly got word that there would be a combined subcommittee hearing for the bill — and soon — we were very happy. We quickly organized our supporters, put together our supporting speakers, and made sure we had a great turnout for the hearing.

For me, one of the most interesting aspects of that first hearing was the questions and comments made by the legislators on the subcommittees (and by the speakers in opposition). That experience helped me to draft an improved version of the bill in the next session (HB 3 — since we didn’t get a vote after the first hearing), to cover areas that obviously needed revision. It also helped me to realize that I had actually underestimated the legislators’ lack of understanding of what the Constitution requires when it comes to “legal tender” in the States.

That point was driven home when another State Representative on the committee — again, someone I had dealt with a number of times in the past, whom I knew to be a pretty strong limited-government conservative who often spoke strongly in favor of strict constitutionalism — took out a dollar bill during the hearing, held it up, and asked me point-blank:

“This Federal Reserve Note printed by the United States of America… it’s stamped on here, it says that ‘This note is legal tender for all debts, public and private’… and it has the force of law, correct?”

First, I made a small correction in his statement — Federal Reserve Notes are only technically printed by the United States government (Bureau of Printing and Engraving); they’re printed for the Federal Reserve, which of course is not an agency of that government. Then I responded that yes, it is U.S. law that FRNs are legal tender for all debts, public and private; but I also reminded him that the U.S. government is under the U.S. Constitution, so any “law” that’s passed only has the force of law if it’s Constitutional. (He asked me if it has been found to be unconstitutional by any court, to which I replied, “Not yet.”)
The point which he was trying to make, in the limited amount of time we had, was that Congress had passed a law declaring Federal Reserve Notes to be “legal tender for all debts, public and private,” and so, he believed, States are required to obey that law and use FRNs for all debts owed by and to the State. Therefore, he claimed, the Constitutional Tender Act — which would force the State to once again not “make any Thing but gold and silver Coin a Tender in Payment of Debts”, as required by Article I, Section 10 — was unnecessary, since Georgia was in compliance with federal law.

But the point which I was trying to make in response, in the limited amount of time we had, was that since that section of the Constitution has never been amended in any way, the State was still required to only use gold and silver for all of its debts, regardless of anything that Congress may tell them to do to the contrary — because Congress cannot force States to disobey the Constitution. As noted in our FAQ,
“Laws passed by Congress, such as legal tender laws, cannot contradict the Constitution. Article I, Section 10 states very clearly: ‘No State shall… make any Thing but gold and silver Coin a Tender in Payment of Debts.’ Therefore, if any State accepts or pays with – in other words, “tenders” – any other ‘Thing’ (such as Federal Reserve Notes) except gold or silver coins, it is in violation of the Constitution. It’s that simple.
Another thing to consider is that the U.S. Supreme Court itself has stated in Lane County v. Oregon, 74 US 71 (1868), ‘the general words “all debts” were not intended to be taken in a sense absolutely literal… the clause making the United States notes a legal tender for debts has no reference to taxes imposed by state authority, but relates only to debts in the ordinary sense of the word, arising out of simple contracts or contracts by specialty, which include judgments and recognizances.’ It also stated in Hagar v. Reclamation District No. 108, 111 U.S. 701 (1884), ‘The acts of Congress making the notes of the United States a legal tender do not apply to involuntary contributions in the nature of taxes or assessments exacted under state laws, but only to debts in the strict sense of the term; that is, to obligations founded on contracts, express or implied, for the payment of money.’”
Think of it this way: in the same section of the Constitution (Article I, Section 10), it states, “No State shall… coin Money”. Now, imagine that Congress, as a cost-cutting measure (I know, I’m dreaming here), decided to shut down the U.S. Mint, which coins all of our money (under Section 8). They realize that we all still need quarters, dimes, nickels and pennies, so they pass a law requiring every State to coin its own money.

Well, then, that means that every State would have to coin money, right? It’s the law!

Wrong. As I tried to explain to that State Representative, any “law” that’s passed by Congress only has the force of law if it’s Constitutional. Article VI, Paragraph 2 states, “This Constitution, and the Laws of the United States which shall be made in Pursuance thereof… shall be the supreme Law of the Land.” So if a law is passed which is not made in pursuance of the clear words of the Constitution, than that “law” is not a “law” at all — as John Marshall, the first Chief Justice of the U.S. Supreme Court, said in Marbury v. Madison, 5 U.S. 137 (1803), “an act of the legislature, repugnant to the constitution, is void.” Justice Stephen Johnson Field, delivering the opinion of the court in Norton v. Shelby County, 118 U.S. 425 (1886), wrote, “An unconstitutional act is not a law; it confers no rights; it imposes no duties; it affords no protection; it creates no office; it is, in legal contemplation, as inoperative as though it had never been passed.” Alexander Hamilton, the first U.S. Secretary of the Treasury and the man whose face graces the ten-dollar bill, wrote in The Federalist No. 33, “acts of the large society [that is, the federal government -- WG] which are not pursuant to its constitutional powers… will be merely acts of usurpation, and will deserve to be treated as such.” And Thomas Jefferson, the principal author of the Declaration of Independence and the third President of the United States, stated emphatically in the Kentucky Resolutions of 1798, “Whensoever the General Government assumes undelegated powers, its acts are unauthoritative, void, and of no force.”

Therefore, if Congress passed a law requiring every State to coin its own money, that “law” would be in direct contradiction to Article I, Section 10: “No State shall… coin Money”; that “law” would not be made in pursuance of the clear words of the Constitution, which is required by Article VI, Paragraph 2; and so that “law” would be “void,” “unauthoritative,” an act of “usurpation,” “not a law,” and “inoperative as though it had never been passed.” In other words, every State would be Constitutionally required to NOT follow that “law,” and ONLY follow the clear instructions of the Constitution itself.

The same would hold true if Congress passed laws requiring States to enter into a Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; emit Bills of Credit; pass Bills of Attainder, ex post facto Laws, or Laws impairing the Obligation of Contracts; or grant Titles of Nobility — because every one of those things is clearly and expressly prohibited for the States in Article I, Section 10… just like coining money.

So then, what about that law, which says that Federal Reserve Notes are “legal tender for all debts, public and private”? Does it mean, as that Georgia legislator implied, that States are required to obey that law and use FRNs for all debts owed by and to the State? And does it mean, as he further implied, that the Constitutional Tender Act was unnecessary, since Georgia was in compliance with federal law?

Obviously, the answer is an emphatic NO. By following that law, like every other State in America, Georgia has made some other “Thing” a ”tender in payment” (that is, they have made something else an offer as payment); they have by law declared that they will accept, and pay out, Federal Reserve Notes for any debts owed to or by them. Therefore Georgia, like every State, is in violation of Article I, Section 10 of the U.S. Constitution. That is why there is a need for the “Constitutional Tender Act” — a bill template that can be introduced in every State legislature in the nation, returning each of them to adherence to the United States Constitution’s actual “legal tender” provisions.

Hey — why not join us, and take action in your State?

(By the way, “legal tender” laws, along with the Federal Reserve Act itself, very likely are unconstitutional, so States could probably “nullify” those laws as well; but that can be saved for another article.)

"The Constitutional Tender Movement in Georgia"

by William Greene, Ph.D.
ConstitutionalTender.com

In early 2009, I was teaching a course on American Government at Gainesville State College here in Georgia. As I was going over with my students the powers prohibited of the States in Article I, Section 10 of the U.S. Constitution, we hit upon this one: “No State shall… make any Thing but gold and silver Coin a Tender in Payment of Debts”.

A student in the back of the room raised his hand, and asked, “What does Georgia use for paying its debts – money owed to the State, and by the State?”

“Federal Reserve Notes,” I replied.

“Not gold or silver coins?” he asked.

“No, not gold or silver coins. And no, Federal Reserve Notes are not backed by gold or silver coins, either.”

He raised his hand again. “Which States DO use gold and silver coins for paying State debts?”

“None of them,” I answered. “They all use Federal Reserve Notes, which were declared to be ‘legal tender’ by the U.S. Congress.”

“When did we pass a Constitutional Amendment to change this requirement in Article I, Section 10?” He had a puzzled look on his face.

My answer seemed to puzzle him even more. “We didn’t.”

It was quiet in the classroom at that point. I waited. I didn’t have to wait for long.

“How have the States gotten away with that?”

I didn’t have an answer to that question. And it bothered me...

Constitutional Tender Act RE-Introduced in Georgia!

The "Constitutional Tender Act" has been re-introduced in the Georgia House of Representatives by Rep. Bobby Franklin (R-43), a member of the Georgia House Banks & Banking Committee, for the 2011 Session of the Georgia Legislature. The bill number is HB 3.

It will take a strong dose of involvement from citizens across the country to get our States back on track using Constitutionally-mandated money, so we'll need YOUR help!

Every citizen TODAY needs to contact the Leaders of the Georgia House of Representatives and ask them to support this bill -- CLICK HERE to take action NOW!

Final Push for SB 416 - "Sound Money in Banking Act"

So, this Friday (March 26th) is "Crossover Day" in the Georgia legislature. That is, if a bill doesn't get passed by a chamber by Friday, it cannot "cross over" to the other chamber to be passed into law.

We've pushed hard over the past year for HB 430, the "Constitutional Tender Act," here in Georgia. We got it a large hearing before two combined subcommittees - something that had never been done before with a bill like this. But then, the subcommittee chairs wouldn't hold a vote on the bill, in order to send it up to the full committee for a hearing and vote; so, we couldn't get it to the full House for a vote, either.

(Feel free to contact the chairmen of the subcommittees, Mike Coan and Calvin Hill, to let them know what you think of them bottling up this simple bill to return Georgia to its Constitutional requirements of sound money.)

Last month, we saw a new bill introduced on the Senate side: SB 416, the "Sound Money in Banking Act," which is basically one-half of the Constitutional Tender Act (the half dealing with getting banks to offer accounts based on legal tender Gold Eagles and Silver Eagles). This bill quickly garnered the co-sponsorships of over 25% of the Senate Banking and Financial Institutions Committee; however, the chairman of that committee, Sen. Bill Hamrick, has yet to bring the bill up for debate and a vote.

After Friday, it will be too late. So, this is the last chance we'll have this session to get any sound money bill through the Georgia legislature.

This week, I faxed a letter to 1,079 bank presidents across Georgia, which said this:
I'm writing to you today to ask you to take a very important action in order to SAVE the rapidly failing banking industry in the State of Georgia.

As you know, times are tough for banks right now. In fact, Georgia is leading the nation in the number of bank failures over the past year. More than three out of five Georgia banks were unprofitable in 2009, over twice the national average. The banking industry desperately needs new ways of bringing in business, customers, and money.

Thankfully, State Senator David Shafer, a member of the Senate Banking and Financial Institutions Committee, has introduced SB 416, the "Sound Money in Banking" Act. This bill would require any bank serving as a depository for the state to offer and accept legal tender gold and silver coins for deposit. Such a bill could SAVE the banking industry - and YOUR bank.

If banks in Georgia were to allow their customers to establish legal tender gold and silver accounts, there will be a HUGE influx of customers not only from across Georgia, but from across the nation; this is the Georgia banking industry's best opportunity to attract the record-breaking legal tender silver and gold coin business, now at over 30 million Silver Eagles and nearly 2 million Gold Eagles per year. That would be an increased reserve of over $2.2 BILLION in value in Georgia's banks - and NO other state is offering this service in its banks!

Right now, over 25% of the members of the Senate Banking and Financial Institutions Committee are already co-sponsors of this bill. But in order for the bill to continue to move forward, we need for SB 416 to be voted OUT of committee, and passed in the full Senate - before THIS FRIDAY, March 26th! Otherwise, the bill will DIE this year.

Right now, I'm asking you to please contact Sen. Bill Hamrick, the Chair of the Committee, at 404-656-0036. Ask him to schedule a hearing and a vote for SB 416, the "Sound Money in Banking" Act, THIS WEEK. Next week will be too late. The future of banking in Georgia is depending on YOU right now. Thank you.
I've also sent a message to all 1,296 members of our ConTen Facebook cause/group, asking them to contact Sen. Hamrick as well. I've done the same to the 5 co-sponsors of the bill. And, of course, I've contacted Sen. Hamrick directly, to make my case once again.

And now, I'm asking YOU to do the same. Please call Sen. Hamrick at 404-656-0036, email him at bill.hamrick@senate.ga.gov, and/or fax him at 404-651-6767. Ask him to please schedule a hearing BEFORE FRIDAY for SB 416, and tell him why it's important: to save the Georgia banking industry, and restore sound money for our citizens.

Thank you for your help, and your support. Let's keep pushing. We have to; it's our moral duty to our neighbors and fellow citizens.

We have ONE WEEK to get SOUND MONEY in Georgia!

March 18, 2010

Dear Supporter of Sound Money,

We have four favors to ask of you - and we are asking every last one of you, PLEASE take action TODAY. As the largest grouping of supporters of Sound Money and Constitutional Tender, we CAN influence the 2010 session of the Georgia State Assembly, but ONLY if people step up and are heard. The next seven days need to be busy ones for you, the Sovereign Citizens. Let's take advantage of our numbers and commitment to the cause.

"Crossover day" is fast approaching. This is the day when bills that do not pass one chamber or the other are DEAD. This year, it appears that crossover day is going to be next Thursday, March 25, 2010. This date is only ONE WEEK AWAY.

Our two supported bills - HB 430, the "Constitutional Tender Act," and SB 416, the "Sound Money in Banking Act" - are still alive and kicking. HB 430 has had a big hearing before the Banks and Banking Committee's combined Financial Institutions & Services Subcommittee / Regulations & Oversight Subcommittee; and SB 416 has received the co-sponsorship of a full 25% of the Senate Banking and Financial Institutions Committee!

HOWEVER, neither of the bills have been voted on by their full committees, in order to get them a full vote on the floor of the House and Senate. Again, a floor vote MUST take place by Thursday. We have worked through the schedule that we provided our supporters for contacting the House and Senate Committee Members - without success. TIME IS NOW SHORT. Personal contacts are best, but if you cannot do that, then PLEASE write, email, fax, and call on the telephone. With almost 3,000 members, we should be able to FLOOD them with paper over the next week.

PLEASE do the following four things:

(1) If you have not yet contacted the House Banks & Banking Committee Chairman, Rep. James Mills, PLEASE do so. Mail a paper letter, and, in addition, fax it if you have access to a fax machine. Send an email, and call. If you previously sent an email, then write a paper letter, mail it, fax it, and call.

2010 is the last year of a two year session. March 25, 2010 will be the last day to pass HB 430 out of the House and cross it over into the Senate, and the last day to pass SB 416 out of the Senate and cross it over into the House. PLEASE DO NOT DELAY!

The devaluation of Federal Reserve Notes - the U.S. Dollar - will grind on with or without your participation. The time to act is NOW if you wish to influence the passage of HB 430 and SB 416 and restore Sound Money to Georgia -- and then to the country. WE HAVE ONLY ONE WEEK LEFT. Let's make the best of it. Please make the contacts needed to pass HB 430 and SB 416 out of House and Senate.

Thank you!

What Is The Constitutional Tender Act?

Great little post that succinctly describes the Constitutional Tender Act. Thank you, "Gemologist Sam"! :)
What Is The Constitutional Tender Act?

The U.S. economy is having big problems. This is not news! But some legislators in Georgia think they have a solution to the problem. While it would only impact their State, their hope is that if the bill passes they will set a good example for other states as well as the Federal Government.

The Constitutional Tender Act is Georgia House Bill (HB) 430. It was introduced by Representative Bobby Franklin (R-43) in 2009. He points out that the United States Constitution declares (Article I, Section 10) that “No State shall…make any thing but gold and silver coin a tender in payment of debts.” However this is no longer the case.

States Rights Bills Now Calling for Gold and Silver Money

Posted on the AOCS Direct blog, from the American Open Currency Standard
Feb. 1, 2010

Executive Summary – Well this wasn’t hard to see coming. The states are scared of the Fed. The big threat is the Fed declares martial law and closes the state governments making them irrelevant. The states in fear for their own governments existence are passing states rights bills. These basically go back to the constitution reasserting that the states created the Federal Government. The constitution clearly lists the rights the Federal Government has and clearly states any other rights belong to the states. Unless specifically prohibited to the states.

Gold & Silver Money – The states doing this to date are as follows with the respective bill numbers which you can look up yourself:

Indiana S.B. 453 Colorado H.B. 09-1206 Missouri H.B. 0561 Georgia H.B. 430 Maryland H.J.R. 5

None of these bills has yet passed. They basically are saying the state has to operate based on gold and silver. They also say the banking system has to allow people to operate using gold or silver. I believe using a paper note backed 100% by gold or silver would be allowed.

Some of the bills also talk of electronic representation of actual gold or silver. They are talking 100% backed currency, not partial fiat money and the electronic aspects would enable bank to bank electronic transfers of this god and silver money.

Discussion – Reading between the lines what you get is citizens will be able to bank and conduct commerce in gold and silver. States will have to do so. I think there would be a marked preference for gold and silver and many merchants would not want to take federal reserve fiat notes or if they did take them at much higher prices. It is a back door to a solid constitutional monetary system. It is also a sign of the states getting ready to break away.

To secede the states need a monetary system and banking system that is not dependent on using the federal reserve fiat notes backed by nothing at all. They will arrange for bank-to-bank transfer of gold and silver electronically. Exactly how remains to be seen but the virtual currency guys have been doing it for ten years.

Curious how birth certificate free Obama stays away from even mentioning states rights. He sure is working overtime to get control measures passed by any means he can conjure up. Funny with all the homeless, out of work folks, people without healthcare, businesses failing he should chose to make gun control a priority. What’s wrong with this picture.

If the states rights every gets legs and either controls the Fed or the states secede and form new countries the people should know that is was the vast gun ownership and shooting skills in the USA that kept the Fed from just asserting martial law and turning the country into a real nightmare. Have you ever seen a anti-gun politician who is also against high taxes?

One year later: Gold and The Constitutional Tender Act

Here's a great blog post at the Campaign For Liberty site about our efforts here in Georgia:
I'll start out with this disclaimer: I am not an economist. I'm an "average Joe," who has an avid interest in Austrian economics, and knows the basic essential rule of Economics: Supply and Demand. Most of what I write here is just my thoughts, and is purely based on some trends I've noticed. For that matter, if you agree or disagree, I'd like to hear your comments so that I can better understand what the hell is going on. I'd also like to know if, had the Constitutional Tender Act been implemented, A) would we be in a better position today than a year ago? B) would it been about the same? (no harm, no foul), or C), would things be worse? Any and all criticism, accolade, and/or input is welcome.

State considers return to gold, silver dollars

State considers return to gold, silver dollars
Proposed bill slams Fed, allows payments in precious metals

By Drew Zahn
© 2009 WorldNetDaily

A bill being considered in the Montana Legislature blasts the Federal Reserve’s role in America’s money policy and permits the state to conduct business in gold and silver instead of the Fed’s legal tender notes.

Montana H.B. 639, sponsored by State Rep. Bob Wagner, R-Harrison, doesn’t require the state or citizens to conduct business in gold or silver, but it does require the state to calculate certain transactions in both the current legal tender system and in an electronic gold currency. It further mandates that the state must accept payments in gold or silver for various fees and purchases.

Two Recently-Discovered YouTube Videos

We just stumbled across two good home-made YouTube videos that are relevant to the use of Constitutional Tender or to the Constitutional Tender Act itself.

The first discusses a number of different news items, but check out what is said beginning at 7:18:

The second has some interesting information regarding the fact that States have abandoned their Constitutional requirement to use ONLY gold and silver coin in payment of debt, and how that fact can actually benefit you in issues of taxation and fees... if you're willing to take that chance! :-)

Let's get our States back to doing what the Constitution REQUIRES them to do, and we won't have to "play around" with this kind of stuff!

Silver-90% Silver & ASE requested as payment under Ga. HB 430 as payments to the State in 2011

[UPDATE] Looks like "Michael" removed this video from YouTube. Oh well - thanks for having it up while you did! :-)

This is an interesting post by "Michael" on YouTube, who writes that he is from "deep Southern Georgia".

A good take on the Constitutional Tender bill.

Thanks for promoting it, Michael!

One Thousand Supporters today!

Hi folks - I haven't written since the end of the legislative session here in Georgia, but I wanted to give you a quick update:

We've now hit ONE THOUSAND SUPPORTERS in our cause on Facebook! (Thanks, Tara!) That puts us at "Guild" status (only 1500 more needed to reach "Tribe" status!).

That's FANTASTIC. Things are going to start heating up again as a number of state legislatures (maybe including Georgia) go back into session, and we see our efforts moving forward. As the economy nosedives, thanks to fiat money and the fractional reserve system, more and more people are looking to REAL money -- CONSTITUTIONAL TENDER -- as the only real solution to what our "leaders" and the Federal Reserve have brought upon us.

We CAN win this -- if we stick to it! Thanks so much for being willing to support this cause, and God bless!

Constitutional Tender - Wow, Check It Out!

Dear Friends of Constitutional Tender,

One week ago, we sent a message to all of the members of our Facebook "cause," that we had reached another milestone in our efforts to return our States to using REAL money: namely, that we had reached 500 MEMBERS, making us an official "SQUAD"!

That was then; THIS IS NOW. In just ONE WEEK, we added ANOTHER 100 members!

It took us 11 weeks to get from zero to 500... then it only took ONE week to get to 600!

So what does that mean? It means we're only 400 members away from the next level of "GUILD" (1000 members) -- and at this rate, we could hit that in just a couple of weeks!

This is an incredibly important cause -- perhaps one of the most important causes on Facebook, when it comes to the best chance America has to save our economy... and our money.

That's why I'm asking you to do something very special, to advance the cause of returning our States to using what the U.S. Constitution requires them to use: gold and silver ONLY. THAT is what can save our citizens from the coming monetary crash.

If you're not a member of Facebook, and are willing to help out by joining Facebook and then joining the Cause, then go here: http://apps.facebook.com/causes/209010/

If you're already on Facebook... could you go right now and "invite" as many friends as possible to join the "Support the State Constitutional Tender Act" cause? You can invite up to 60 friends a day -- just go here:

http://apps.facebook.com/causes/cause_invitations/new?cause_id=209010

Remember: it's our future we're trying to save. Can you take just a couple of minutes right now to help?

Thank you!

Constitutional Tender: Another Milestone Reached!

Dear Friends of Constitutional Tender,

We have reached ANOTHER milestone in our efforts to return our States to using REAL money:

Our Facebook "cause" has reached 500 MEMBERS! That makes us an official "SQUAD"!

So what does that mean? It means we're ready to take the next ACTION STEP:

Contact YOUR State Representative and Ask Him or Her to Introduce the Constitutional Tender Act!

We've made great progress in Georgia with HB 430, culminating in a two-hour no-holds-barred hearing on the bill before two major subcommittees of the House Banks and Banking Committee. As soon as they come back into their next session, we'll be able to push for a vote to get it to the House floor!

We've also seen other sound money proposals introduced in at least six other states across the country!

All of this has ONLY been possible thanks to patriots like YOU, who have been willing to take a couple of minutes every once in a while to send a quick email, or make a quick phone call, or fax a quick letter. And IT'S WORKING.

But time is growing short. The Federal Reserve keeps pumping TRILLIONS more dollars into our economy, with no end in sight -- which means hyper-inflation is right around the corner. If we want to protect the citizens of each state from the coming monetary collapse, then we MUST get our states to begin the process of adopting SOUND MONEY -- NOW, before it's too late.

So, now we're ready to "branch out" and start REALLY pushing this bill, in ALL 50 STATES!

Think about it: with just our Facebook members alone (not to mention the many more who support this bill outside of Facebook), we can generate over 25,000 MESSAGES to every State Representative in every State in the Union.

TWENTY-FIVE THOUSAND MESSAGES, and every single one of them asking for one simple thing: INTRODUCE THE CONSTITUTIONAL TENDER ACT IN YOUR STATE!

So here's the steps YOU can quickly take to make a HUGE impact in advancing the goal of returning every State to the use of Constitutional Tender -- REAL money -- as they are required to do:

If you don't know how to contact your State Representative...

  • Go to http://www.congress.org/
  • Enter your ZIP code in the box where it says "Find Your Officials" or "My Elected Officials" and click "Go"
  • On the next page, fill in your "ZIP + 4" OR fill in your full address in the boxes in the middle of the page
  • Click on the name of your State Representative
  • Click on your state legislator's Contact tab
  • Click on the link to Contact your state legislator

Then just write a quick note to your State Representative; you can use the sample message below, or write your own:

***********************************************

Dear Rep. __________________,

As a voting constituent in your district, I am writing to ask you to please introduce a bill called the Constitutional Tender Act.

Time is growing short. The Federal Reserve keeps pumping TRILLIONS more dollars into our economy, with no end in sight -- which means hyper-inflation is right around the corner. If we want to protect the citizens of our state from the coming monetary collapse, then we MUST begin the process of adopting SOUND MONEY -- NOW, before it's too late.

The surest and quickest way to do that is to simply do one thing: OBEY THE U.S. CONSTITUTION. In Article I, Section 10, it reads, "No State shall... make any Thing but gold and silver Coin a Tender in Payment of Debts". But, in fact, our state DOES make some other "Thing" besides gold and silver coin a "Tender in Payment of Debts" -- some "Thing" called "Federal Reserve Notes." That's why we need the "Constitutional Tender Act" -- a bill that would return our state to adherence to the United States Constitution's actual legal tender provisions.

A bill like this, that would mandate the use of only constitutional money in state transactions (taxation and payables, contracts, etc.), would immediately begin the flow of real wealth toward our state's treasury. This would stabilize the our state's economy, protect the pensions of state employees, etc. -- and offer many other immediately recognizable benefits.

The Constitution is the only true "hedge fund" that can protect the people of our state from the effects of inflationary paper money.

I'm sure you have a lot of questions about how such a bill could work, and how it can save our state from the collapsing economy. Please do me this favor and visit this website: http://www.ConstitutionalTender.com/ . Here you can click on "FAQ" to read the answers to almost all questions about this bill.

You can also click on "Template" to download this bill in Word, PDF, or Text format, in order to modify it so that you can introduce the bill in our state's legislature.

This bill has already been introduced in other states like Georgia, where it is now winding its way through the approval process. We need to make sure the citizens of OUR state are protected, too. PLEASE, introduce the Constitutional Tender Act -- and begin the process of adopting SOUND MONEY once again in this great state. Thank you.

Sincerely,

***********************************************

Now, we've made this as simple as possible; if you already know who your state legislator is and how to contact him or her, please do so! If at all possible, send an actual email with the Bill Template attached (in PDF, Word, or Text format, available for download from our website).

And by the way, if you live in Georgia -- just modify the letter to ask your Representative to SUPPORT HB 430 in the State House!

PLEASE, take just a couple of minutes of your valuable time to send this message. If we ALL take part -- and send over 25,000 MESSAGES -- we can make a REAL difference for REAL money, in every single state!

Thank you!

Constitutional Tender Bill was heard in Committee!

Dear Friends of Constitutional Tender,

This week, HISTORY WAS MADE. And we have patriots like YOU to thank for it, because YOU took the time to demand that legislators LISTEN.

Now, we have another quick task to do -- which we'll tell you in a moment.

This week, testimony was given at the Georgia House combined Financial Institutions & Services Subcommittee / Regulations & Oversight Subcommittee hearing on HB 430, the "Constitutional Tender Act". Testimony in favor of the bill was given by Rep. Bobby Franklin, Bill Greene, Aaron Krowne, Sean Mangieri, Jesse Bickel, and Franklin Sanders.

View the testimonies here:
http://www.youtube.com/watch?v=_u3B2KbVWto
http://www.youtube.com/watch?v=Sv1MDWac9-E
http://www.youtube.com/watch?v=kXqNQNj4T-M
http://www.youtube.com/watch?v=peEs2SteMM8
http://www.youtube.com/watch?v=9oHqdEf0Hjk
http://www.youtube.com/watch?v=2VKvzeePmL4

The witnesses testified and explained to the Members of these Banks and Banking Committee subcommittees the absolute requirement of the U.S. Constitution for the State of Georgia to ONLY use gold and silver coins in its transactions, and a dialogue was begun in the best MEANS by which this should be done. The bureaucrats and banking lobbyists were concerned with cost, efficiency, and change, but it was apparent that they had not read the bill thoroughly or with an open mind, and especially had not read the FAQ on the ConstitutionalTender.com website.

These experts and Rep. Franklin explained to the Members the need to shift away from our fiat money system, and into a sound money system. The hyperinflationary end of various countries' fiat money was explained. The fallacies of fractional reserve banking was shown, and how the system robs the inherent wealth of the American citizens. The likely complete devaluation of Federal Reserve Notes, and thus the need for Georgia to protect its citizens via returning to Constitutional Tender, was also explained.

Testimony in opposition to the bill was given by a state bureaucrat and two banking industry lobbyists. Dan Ebersole, Director of the Georgia Office of Treasury and Fiscal Services, worried that the State would have to start storing physical gold and silver right there in their office, and he'd have to have a bodyguard wherever he went. The question, of course, is why would it have to store the gold physically, if we are already dictating that depositary banks will have to have the appropriate gold/silver backed accounts? Do they have to store physical Federal Reserve Notes right there in their office, too?

Mr. Ebersole also worried that he would have a hard time investing the State's money if we went back to using Constitutional tender. What he doesn't seem to understand is that, as the value of FRNs drops like a base-metal balloon, all that fiat money he has so "wisely" invested will be GONE -- and the people of this State will want to know just WHO is responsible.

The two banking industry lobbyists, Joe Brannen of the Georgia Bankers Association and Steven D. Bridges of the Community Bankers Association of Georgia, were worried that they'd have to change the way they do business. They might have to convert FRNs to real money; they might have to store gold and silver in vaults; they might have to hire bank security; they might have to initiate electronic transactions...

In other words, as one of our folks remarked, it was largely a puerile dodge, where they pretended like we were demanding they go back to pre-19th century money handling, where there aren't even banks and so every transaction consists of gold coin being moved around. They then made a straw man out of that. In reality, we are merely establishing gold coin as a standard backing for electronic money in the manner of the current banking system.

Overall, our folks -- simply citizens of the Sovereign State of Georgia, not bureaucratic wonks or paid lobbyists -- made stunningly adept & forceful presentations. Yes, there was at least one legislator that left in a red-faced huff, remarking that he wasn't going to "waste his time" listening to this stuff; but it was just as clear that many eyes were opened that day, and it seems that several legislators were actually swayed by the sound argumentation.

So, I repeat: HISTORY WAS MADE.

But our work is FAR from over.

You see, with only one week left in this particular session of the Georgia legislature, we won't be able to get a vote on HB 430 yet. It will still be alive (GOOD NEWS!); but in order for the bill to continue to move forward, we need for the next important step to take place:

The LEADERS of the Georgia House of Representatives MUST hear from the people about how IMPORTANT this bill is, and WHY it needs to be considered by the ENTIRE House next session!

So, fellow Constitutionalists, we need to TAKE ACTION AGAIN! Here's how:

  • Contact the two Republican leaders of the Georgia House, Glenn Richardson & Jay Roberts -- their contact info is at the bottom of this message.

  • Quote Article I, Section 10 of the U.S. Constitution to them: "No State shall... make any Thing but gold and silver Coin a Tender in Payment of Debts".

  • Simply ask each Leader to read HB 430, the "Constitutional Tender Act," very carefully. It's only four pages long, so it's simple and straightforward. If you're emailing them, point them directly to the bill and to the FAQ page -- if you're faxing them, print those out and include them in the fax.

  • If you want to write more, explain to these Leaders why this bill is so important: because Georgia, like every other state, is in violation of the U.S. Constitution without such a bill (because the State is making some other "Thing" a Tender in Payment of Debts, both to and by the State). Remind each one that State legislators are all required to swear an oath to uphold that Constitution, so ethically and morally they need to do whatever the Constitution requires.

  • You could also inform the Leaders that this type of bill is also needed because, due to the ever-widening circle of economic disaster that is affecting the citizens of every State, we MUST do something to at least begin the process of restoring sound money and a sound economy, whether or not the Federal government or any other State government does so. This would immediately begin the flow of real wealth toward the state's treasury. This would stabilize the state's economy, protect the pensions of state employees, etc. -- and offer many other immediately recognizable benefits.

  • THANK YOU SO MUCH -- it's because of people like YOU, who are willing to take a few minutes of your valuable time to do something like this, that this bill has moved further through the General Assembly than we EVER thought it would this year! We CAN get it even further over the next few months! :-)

Constitutional Tender hearing scheduled - please help!

    Dear Friends of Constitutional Tender,

    YOU DID IT!

This week, we asked you to contact the Chairmen of the two subcommittees that HB 430, the "Constitutional Tender Act," was assigned to. Well, you must have done a good job -- because we got a call today from Rep. Calvin Hill's office, letting us know that the subcommittees will be holding a combined hearing on HB 430 -- THIS TUESDAY, March 24th, from 10am-12pm! (in room 415 of the Coverdell Legislative Office Building)

That means we're scrambling to bring in people to testify for those two hours -- experts, regular citizens, etc. But the BIGGEST thing we need is to FILL THAT COMMITTEE ROOM with supporters of the Constitutional Tender Act!

It's a sure bet that there will be lobbyists there to testify AGAINST this bill. The Georgia Bankers Association has gone on record in opposition to it. The lobbyist for the Community Bankers Association of Georgia stated clearly that they would fight it. And these guys carry a lot of political clout.

THEY will be there. Will WE?

You see, WE carry clout, too. Or at least -- we SHOULD. We should be able to stand up and demand that our legislators OBEY the U.S. Constitution.

We shouldn't HAVE to demand it -- but we SHOULD be able to MAKE it happen!

There are a number of Members of these subcommittees who have a good idea of what this bill is attempting to do. But in order for the bill to continue to move forward, we need for the next important step to take place:

The members of these subcommittees MUST hear from the people about how IMPORTANT this bill is, and WHY it needs to be voted favorably back up to the Committee!

So, fellow Constitutionalists, we need to TAKE ACTION AGAIN! Here's how:
    • Contact the members of the two subcommittees -- their contact info is at the bottom of this message. We've listed them out individually, with names, phone numbers, and email addresses; we've also grouped their addresses with commas and grouped them as a list, so you can pick a list to cut and paste them into your email "To:" line.
    • Quote Article I, Section 10 of the U.S. Constitution to them: "No State shall... make any Thing but gold and silver Coin a Tender in Payment of Debts".
    • Simply ask each Member to listen to the testimony on HB 430 with an open mind. Ask them to please begin each question they may have with this phrase: "Since the U.S. Constitution requires every state to ONLY use gold and silver coins in payments to and by the State, then... [insert question here]".
    • If you want to write more, explain to each Member why this bill is so important: because Georgia, like every other state, is in violation of the U.S. Constitution without such a bill (because the State is making some other "Thing" a Tender in Payment of Debts, both to and by the State). Remind each one that State legislators are all required to swear an oath to uphold that Constitution, so ethically and morally they need to do whatever the Constitution requires.

Constitutional Tender - Help Needed TODAY

    Dear Friends of Constitutional Tender,

I need your help RIGHT NOW, to take ONE MINUTE of your very valuable time, for a very quick Action Item to advance HB 430, the "Constitutional Tender Act."

Tomorrow - Wednesday - I'm heading down to the State Capitol in Atlanta, to lobby several key legislators on the bill, including: Rep. Calvin Hill, Chairman of the Financial Institutions & Services Subcommittee, and Rep. Mike Coan, Chairman of the Regulations & Oversight Subcommittee.

One week ago, Rep. Bobby Franklin, who sponsored HB 430, asked these two Chairs to schedule subcommittee hearings "for the purpose of obtaining input and suggestions from the banking community on how to best comply with the Constitution's mandate that the State use only gold and silver coin."

    http://www.sicm.com/constitutionaltender/BillRequest-HB430.pdf

To date, neither has agreed to do so -- even though both had said they would.

So today, RIGHT NOW, I'm asking you to do just one quick thing: Drop Rep. Hill (chill@gilainc.com) and Rep. Coan (repcoan@charter.net) a quick email.

It doesn't even matter if you live in Georgia. They MUST hear from a LOT of folks, so we can move this bill forward! Again, their contact info is:

    * Chairman of the Financial Institutions & Services Subcommittee, Rep. Calvin Hill (R-21) - chill@gilainc.com - 404-656-0129

    * Chairman of the Regulations & Oversight Subcommittee, Rep. Mike Coan (R-101) - repcoan@charter.net - 404-656-6801

THANK YOU SO MUCH -- it's because of people like YOU, who are willing to take a minute of your valuable time to do something like this, that we have a GOOD SHOT at getting this bill moved through the General Assembly this year -- and even introduced in other states!

    LET'S ROLL!

Business Journals report on the Constitutional Tender Act

One of our folks was handed a copy of last week's Atlanta Business Chronicle at a Toastmaster's meeting recently. Inside was a long article on the Constitutional Tender Act!

Click Here to read the article in its entirety. (By the way, the article was apparently also published in sister business journals across the country!)

Of course, as happens in the media, there were misunderstandings of the bill. For example, it said that while "the state would accept checks or other payments linked to gold coin- or silver coin-backed accounts," it could also "accept Federal Reserve dollars — the existing U.S. standard for nearly four decades — for other types of transactions." That, of course, is incorrect; that section of the bill is referring to what everyone ELSE in the State is allowed to do -- they can use gold, silver, or even worthless pieces of paper with pictures of dead politicians on them. It's their choice under this bill.

Also, as happens with members of academia, there were even more misunderstandings of the bill. Surprisingly, they came this time from Dr. George Selgin, the "BB&T Chair in Free Market Thought / Professor of Economics" at West Virginia University, whom the article called "an expert on the history of currency standards and monetary theory." Here's what he had to say:

Selgin said the challenges of re-introducing such a standard, if the bill became law, are numerous.

“We as a country walked away from gold to fiat money,” Selgin said. “It’s very hard to walk back.”

Selgin said he sees the bill, rather than attempting to re-introduce a now-defunct financial standard, as creating the artifice of one.

“Banks would have to meet two sets of standards, one for doing business with the state, and one for everyone else because everyone else uses another standard,” he said. “You’re asking them to create parallel systems, and that’s very difficult.”

OK, yes, "it's very hard to walk back" to real money. No one is saying that would be something that could happen overnight. BUT, this bill would actually put us on that ROAD back to real money -- by introducing competition in currency. By getting the State to obey the Constitution, and ONLY use gold and silver coin in receiving and making payments, we can begin to get people used to using real money again, because they'll have to use it in their transactions with the State. Once they start doing that, they'll be more willing to use it in their everyday transactions as well -- especially as the fiat money continues its spiral downwards in purchasing power, and the gold and silver maintains its value. At that point, we can see "Gresham's Law" work in reverse -- good money will chase out bad money.

What is most unsettling, though, it that a prominent academic like Dr. Seglin is willing to look at a bill that attempts to make the State obey the U.S. Constitution in the area of money... and he calls it "a bit kooky." Instead of making suggestions of better ways to make the State enforce the requirement for Constitutional tender, he dismisses it outright as just "creating the artifice" of a "now-defunct financial standard."

Is this what "experts" in "free market thought" are teaching in the schools these days?

Constitutional Tender: ONE MINUTE of your time needed right now!

    Dear Friends of Constitutional Tender,

I'm writing this note to ask you to take ONE MINUTE of your very valuable time, for a very quick Action Item to advance HB 430, the "Constitutional Tender Act."

As I reported before, HB 430 was brought up last week in Georgia's House Banks and Banking Committee, and assigned to TWO subcommittees: Financial Institutions & Services, and Regulations & Oversight. This means we're making great progress -- but it also means we now have a LOT of work to do EDUCATING these state legislators on the need for this bill.

For example, this past week, one of our folks met with the Chairman of one of those subcommittees: Rep. Calvin Hill, from the Financial Institutions & Services Subcommittee. In this conversation, Rep. Hill was asked if he would support HB 430; his response was, "I'm with you in spirit, I believe in a gold standard, but I don't think it would be practical to make banks accept gold and silver coins. Where would they store them?"

Yes, I'm not kidding, that's what he said.

Another one of our folks had a chat with the Chairman of the other subcommittee: Rep. Mike Coan, from the Regulations & Oversight Subcommittee. In this conversation, Rep. Coan was asked if he would call a hearing to take input from the banks themselves on HOW to enforce the clear language of the U.S. Constitution's requirement for the State to use ONLY gold and silver coins, and since it says we MUST use that, what would be the best way to do so; his response was, "I'll see what I can do."

Yes, that's what he said when asked to get the State to obey the U.S. Constitution: "I'll see what I can do."

We need to set these two gentleman straight on this issue... QUICKLY!

So today, RIGHT NOW, I'm asking you to do just one quick thing: Drop Rep. Hill (chill@gilainc.com) and Rep. Coan (repcoan@charter.net) a quick email.
    • In your emails, you can politely explain to them WHY this bill is so important: because Georgia, like every other state, is in violation of the U.S. Constitution without such a bill (because the State is making some other "Thing" a Tender in Payment of Debts, both to and by the State). Remind them that State legislators are all required to swear an oath to uphold that Constitution, so ethically and morally they need to do whatever the Constitution requires.
    • Inform Rep. Hill and Rep. Coan that this type of bill is also needed because, due to the ever-widening circle of economic disaster that is affecting the citizens of every State, we MUST do something to at least begin the process of restoring sound money and a sound economy, whether or not the Federal government or any other State government does so. This would immediately begin the flow of real wealth toward the state's treasury. This would stabilize the state's economy, protect the pensions of state employees, etc. -- and offer many other immediately recognizable benefits.
    • Finally, ask Rep. Hill and Rep. Coan to please listen with an open mind to the testimony from experts on what exactly it would mean to carry out this bill.
Chairman Hill and Chairman Coan MUST hear from the people about how IMPORTANT this bill is, and WHY it needs to be voted favorably back up to the Committee!

These two subcommittees are going to be holding hearings on HB 430 very soon, and we're going to be bringing in as many of our experts as we can to testify and explain the need and the necessity of passing this bill. We'll be letting you know when those meetings are.

So, fellow Constitutionalists, we need to TAKE ACTION AGAIN! Here's how:
    • Contact the Chairman of the Financial Institutions & Services Subcommittee, Rep. Calvin Hill (R-21) - chill@gilainc.com - 404-656-0129
    • Contact the Chairman of the Regulations & Oversight Subcommittee, Rep. Mike Coan (R-101) - repcoan@charter.net - 404-656-6801
By the way -- you DON'T need to live in Georgia to send these two Chairmen an email! We need EVERYONE'S help!

THANK YOU SO MUCH -- it's because of people like YOU, who are willing to take a minute of your valuable time to do something like this, that we have a GOOD SHOT at getting this bill moved through the General Assembly this year -- and even introduced in other states!

    LET'S ROLL!

Action Needed This Week - Constitutional Tender Act

    Dear Friends of Constitutional Tender,

HB 430, the "Constitutional Tender Act," was brought up this week in the State House Banks and Banking Committee, and assigned to TWO subcommittees: Financial Institutions & Services, and Regulations & Oversight. This means we are making GREAT progress here in Georgia in advancing this bill!

There are a number of Members of these subcommittees who have a good idea of what this bill is attempting to do, including a few co-sponsors. But in order for the bill to continue to move forward, we need for the next important step to take place:
